Terms and Condition

dwservbill.com（以下「当社」とする）が提供するクレジット決済サービス、および、提携サイトのサービスは、以下の条件を理解した上で 利用するものとします。当社が提供するクレジット決済サービスを利用して提携サイトのサービスを購入した場合、以下の条件に同意したものと みなされ、以下の条件に法的に拘束されます。

1. 定義

本利用規約において使用される単語の定義は以下の通りとします。 「会員」および「会員権」　：　当社を利用して購入した、提携サイトの利用に有効なユーザー名およびパスワード（ユーザーID)を保持する会員やユーザー。 「提携サイト」　：　会員にコンテンツサービスを行うサイトで、会員権を購入するための購読手数料の決済業務を当社に委託しているサイト。 「購読手数料」 ：　提携サイトの会員権を得るために必要な料金。 「ユーザーID」　：　サイトへのアクセスに使用する固有のユーザー名とパスワードの組み合わせ。ユーザーIDとは、一定の指定期間、サイトを使用するための許可証となります。 「ブックマーク」　：　URLをブラウザの一時ファイルに設置し、会員が他のページを経由せずに、直接当該ページにアクセスできるようにすること。

2. サービスの概要

当社は、当社が提供するクレジット決済サービスを利用して会員権を購入した提携サイト、及び、提携サイトが提供するコンテンツにアクセスできるように、会員が購入時に登録したメールアドレスに送信する形式でユーザーIDを提供します。

3. 同意条件の変更

会員への通知が個別に行われる事無く、規約は変更される場合があります。規約の変更はこのサイトに掲載された時点で有効となります。会員は、変更点と最新情報を得るために規約を随時確認することに同意します。

4. 申込の成立

購入希望者が、個人情報を入力し、それらを当社に送信した時点で、購入又は申込約諾が成立したものとします。

5. 支払いと手数料

提携サイトには、定期的な購読（以下「定期購読」とする）手数料がかかる場合があります。この手数料は、購読開始時に提携サイトの利用条件に明記、規定され、提携サイトの利用条件に従い購読手数料を支払う責任があります。会員が会員に割り当てられたユーザーIDを使用して提携サイトにアクセスした後は、購読手数料は返金できません。

6. 定期購読と請求

提携サイトの管理者が定める場合、会員が初回決済時に選択した期間の終了後に、自動的に同じ期間の延長更新を行い、延長にかかる購読手数料を自動的に決済することがあります。ただし、更新の７日前に会員から解約の通知を受け取った場合はこれにあたりません。 本利用規約の条件に従って本契約を解約する場合をのぞき、会員は断続的な購読手数料を支払うために当社が会員のクレジットカード情報を使用して請求することを承認します。

7. 解約

当社、および、提携サイトは、電子メールや郵送、電話等で会員に通知を行いサービスを停止することができます。会員は提携サイトにて指定された方法、および、電子メールにて提携サイトの購読を終了することができます。会員による解約の場合には、購読手数料は返金されません。 解約を行う場合、またクレジットカードの不正利用により承認されない使用が行われ、銀行やカード発行会社より返金の要請があった場合、当社は当社の裁量に基づき、提携サイトでのクレジットカードの不正利用が発生しないように処理を行います。ただし、当社にてこのような処理を行っても、当社以外での承認されない使用は防ぐことができません。ユーザー自身でカード発行会社等にご連絡することが必要です。

8. 返金

申込成立後の返金ポリシーは、各提携サイトによって異なります。会員は、サイト利用規約を確認し、その返金方針に合意します。万一、返金がなされた場合、返金はすべて決済が実行された会員のクレジットカードにクレジットバックされる事により実効されます。その他現金、小切手等の方法での返金は行いません。 また、当社は、提携サイトの取引許諾違反または、詐欺行為などを除いて、単独の判断で返金処理に応じません。民事法の原則に従って、会員とサイトの当事者間で話し合って下さい。

9. 禁止事項

会員が、規約に違反し当社、または、提携サイトの権利、利益を侵害、または名誉を著しく貶めた場合、損害賠償の支払いを請求します。 会員は、提携サイトの提供する商品又は、コンテンツを第三者に譲渡または転売する際は、サイト利用規約を遵守する事に同意します。万が一提携サイトの権利または利益の侵害が発覚した場合、会員は当社決済サービスをご利用頂けなくなります。その際、残存する期間の利用料金の返金または、返品等には、一切応じられません。

10. 個人情報の取り扱い

インターネットによるクレジット決済サービスを提供するにあたり、当社は会員の個人情報を収集し、使用し、また一部の個人情報を共有する必要があります。当社は、収集した個人情報を利用し、ご提供するインターネットによるクレジット決済サービスを断続的に更新し、より良いサービスをご提供できます。 当社が収集するデータは、下記の通りとなります。 ※IPアドレス、サービスを購入するＷＥＢサイト、ご購入商品、料金、ユーザー名、電子メールアドレス、郵便番号、国、クレジットカード情報、姓名 当社はデータの公開が、法律の遵守、本契約の執行、提携サイトとの契約上の権利の保護を実施するために適切であると判断した場合、データを提供することがあります。 会員が当社が提供するクレジット決済サービスを利用してサービスを購入した提携サイトの所有者や管理者に対しデータの提供が必要であると判断した場合、当社は下記のデータを提供することがあります
※IPアドレス、サービスを購入するＷＥＢサイト、ご購入商品、料金、ユーザー名、電子メールアドレス

会員からご提供いただいた個人情報は、会員によるサービスの購入時のクレジットカード決済処理、会員自身のサービスに対する問い合わせ対応、損失の防止、会員に対する弊社サービスの向上、会員へのご連絡、および、提携サイトが顧客サービスをご提供してプロバイダーの義務を果たせるようにするために使用します。当社の社員は、必要な場合にのみ会員の情報にアクセスするものとし、法的機関の要請があった場合をのぞき、いかなる理由があっても、第３者に会員の情報を提供することはありません。

11. 保証

当社は、当社の決済サービスをご利用頂いた上で発生するいかなる損害にも、一切の保障はいたしません。

12. 条項の可分規定

何らかの理由により本規約の条項が無効である、または強制力がないとされた場合においても、本規約の他の条項は効力と強制力を保持するものとします。法的機関が、本契約の規定を無効または強制力がないと見なした場合、および、この条項を制限することにより有効または強制力を持つようになると見なした場合、この条項はこの条項を制限するように、記載、解釈、実行するものとします。

13. 注記

提携サイトから会員への通知は、提携サイトを通じた電子メッセージで行うことができます。提携サイトのクレジット決済サービスに関する全ての質問、苦情、通知は、下記の にお問合わせください。 提携サイトのサービス、有効期限、解約に関する全ての質問、苦情、通知は、提携サイトのサポートセンターにお問合わせください。

1. Legal Definitions

2. Description of services

dwservbill.com will provide one user ID to access the Web site and its contents for which you are purchasing membership through email to registered email address of subscribers and/or dwservbill.com will process as a separate order any transaction for the service you purchase from this Web site.

3. Amendment

This Terms and Conditions of the service is subject to change by dwservbill.com at any time and changes shall become effective upon thereof. All subscribers should regularly check back to stay current on any such changes.

4. Application

dwservbill.com assumes that all charges commences and/or application shall be deemed to be executed upon the submission by subscribers of their personal information with regards to the purchase of the product or the service.

5. Fees/Payments

Web sites may have periodic subscription fees that are defined by the Site at the time of the initial enrollment for subscription. The member is responsible for such fees according to the terms of the Site. Once a member has the ability to access the Web site using the user ID assigned to the member, subscription fees become non-refundable.

6. Subscription and Charges

Subject to each Web site at dwservbill.com, terms and conditions may vary. Subscribers hereby acknowledges to the policies provided by each Web site. In the case of the membership fees charged periodically in accordance with the designated schedule to gain access to such Web site for usage of the services, information and products offered thereof, subscribers acknowledges that your credit card will automatically billed each period as designated by each Web site for the current membership fee until you request cancellation of your membership 10 days in prior to your next renewal of your membership.

7. Cancellation

At any time, and without cause, subscription to the Web site may be terminated by either dwservbill.com or the site upon notification to the other by electronic or conventional mail. The subscribers may terminate subscription to the site by the designated method subject to the site or by electronic mail. When the member requests the termination, subscription fees are NOT refunded. Subscribers are liable for charges incurred by them until termination of service.

If you request cancellation or request a refund from dwservbill.com, your bank, card issuer, or phone company due to unauthorized or fraudulent use, dwservbill.com can at its sole discretion, to prevent further unauthorized use, block your information from use at all dwservbill.com's Web sites. This will not however prevent unauthorized use at non-dwservbill.com' Web sites, and is not a substitution for your contacting your appropriate channels to prevent further misuse.

8. Refund

Subject to each Web site at dwservbill.com, refund policies vary. Subscribers hereby agree to the policies provided by each Web site at dwservbill.com. Should a refund be issued, all refunds will be credited to the credit card, debit card, or checking account used in the original transaction solely. Refunds will not be issued by cash, check, or to another credit card. Please allow several period for the refund to appear on the account.

9. Prohibited Action

Subscribers shall at any time, hold harmless and indemnify dwservbill.com and its owners, managers, employees and agents from and against any claim, cause of action, liability, loss or harm caused by or arising from your breach of any of the warranties and representations contained herein and with respect to any breach of any terms contained herein. The material on the service is for the private, non-commercial enjoyment of subscribers only. Any other use is strictly prohibited. Subscribers shall not be entitled for any refunds or any portion paid thereof in case of any action; (a) that is designed to crack the anti-copy code of any data owned or held by each Web site at dwservbill.com, (b) that causes or results in any losses or damages to dwservbill.com and its Web sites or any other third party, (c) that violates the standards and laws of the community in which you live regarding sexually oriented media, (d) that obstructs the normal utilization of internet connections to the public, and (e) that are determined to be improper by the judge of dwservbill.com.

In order to provide credit card processing, transaction and billing services, dwservbill.com must collect, use, and share certain information about you. The information dwservbill.com collects from you helps dwservbill.com to provide you with better service by continually updating the credit card processing, transaction and billing service information. - Service you have purchased

dwservbill.com at its sole discretion may release data when we believe the release is appropriate to comply with the law, enforce our Agreement, and protect the contract rights of our Clients. dwservbill.com passes the following data to the owner/operator of the Web site from which you are purchasing services, or products utilizing dwservbill.com's services:
- IP address
- Web site which you subscribe
- Service you have purchased
- Price of the service
- User ID
- E-mail address

We use the information that you provide for such purposes as processing your credit card transaction, responding to customer service inquiries, loss prevention, improving our service, communicating with you, and allowing our clients to provide customer service and fulfill their obligations to you. dwservbill.com's employees have limited access to your information on a need-to-know basis. dwservbill.com will not sell, disclose nor release your information to any and all independent third parties for any reason except for the extent necessary to respond to a valid order by a court or other governmental body.

11. Indemnity

Subscribers at all time indemnify and hold harmless dwservbill.com along with its affiliated entities, agents, managers, employees, attorneys, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses, including, without limitation, attorneys’ fees, arising from your use of dwservbill.com Web Sites or the activities conducted using your username and password on dwservbill.com Web Sites.

12. Severability

If any provision of this Agreement shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If a court finds that any of this Agreement is invalid or unenforceable, but that by limiting such provision it would become valid or enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited.

13. Notice

Notices by the site to subscribers may be given by means of electronic messages through the site, by a general posting on the site, by electronic or conventional mail. Notices by subscribers may be given by electronic messages, unless otherwise specified in the Agreement. All questions, complaints, or notices regarding a subscription site must be directed to . All questions, cancellations of the service subscription, complaints, or notices regarding a purchased service of the site must be directed to Web site which you have purchased services.
